Markiyan Kliuchkovskyi has over 7 years of legal practice experience, representing clients in commercial and investment arbitrations, transnational litigation, energy disputes, mediation & negotiations and sports law cases. Since joining the Firm in 2004, his practice has encompassed client representation at all stages of proceedings both in court and before arbitral tribunals. His experience includes handling arbitrations held at many major arbitration institutions including the LCIA, SCC, ICC, ICSID, CAS, and AAA, as well as and before ad hoc tribunals.

Mr. Kliuchkovskyi has experience in enforcing foreign court decisions and arbitration awards in Ukraine and in representing sport clubs and players before various courts and tribunals. He regularly represents the interests of Ukraine in various international disputes, as well as of the panel of his clients, which include, among others, DCH, FC Metalist, Bunge, Advent, Altimo, Hochtief and Mr. Boris Fuchsmann. He has also served as an arbitrator to adjudicate commercial disputes.

Over the last two years he has participated in more than 30 cases, including:

  • Successfully representing Ukraine in an unprecedented case against Norsk Hydro on setting aside of a USD 20m arbitration award issued against Ukraine in Swedish courts
  • Representing Ukraine in a case brought against it by Global Trading Resources Corp. and Globex International at the ICSID that resulted in the first ever dismissal of claims against the respondent state on the basis of Rule 41(5) of the ICSID Arbitration Rules.
  • Representing a Ukrainian state-owned oil and gas company in a series of cases (total amount of claims exceeding USD 8bn) over contracts for gas supply, transit and storage at the Arbitration Institute of the Stockholm Chamber of Commerce.
  • Representing a party to a corporate dispute over a large Ukrainian mobile communications operator in numerous jurisdictions.
  • Representing a Ukrainian football club in a case concerning allegations of match-fixing.

Mr. Kliuchkovskyi holds a Master of International Law (with honours) from the Institute of International Relations at Taras Shevchenko National University of Kyiv (emphasis in private international law and international dispute resolution). Markiyan obtained his LL.M. (magna cum laude) at the University of Pittsburgh School of Law (international dispute resolution).
